Evidence

Following the running of Race 6, the Respondent, Apprentice Jockey Mr J Chung, admitted a charge alleging use of whip in consecutive strides over the concluding stages.

Apprentice Rider Mentor, Mr N Harris was present at the hearing and assisted Mr Chung.

Rule638(3)(g)(ii) provides that in a Flat Race a Rider must not:

(ii) strike a horse with a whip in consecutive strides at any stage of the race.

Using the available race films (head and side-on), Stipendiary Steward, Mr Dooley demonstrated that the Respondent struck his mount MERCURIAL 3 times consecutively over the concluding stages of the race.

On behalf of the Respondent, Mr Harris said that immediately after dismounting, Mr Chung realised that he had struck his mount consecutively and due to his inexperience, he will use this as a learning opportunity.

Decision

As the Respondent, Mr Chung admitted the breach the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Mr Williamson advised that Respondent has a clear record under the Rule. He said that Mr Chung has recently commenced race riding and his ride on MERCURIAL was his fourth raceday ride.

Stewards submitted that a penalty commensurate with the NZTR Revised Penalty Guide for a first breach involving three consecutive strides be imposed.

In terms of penalty Mr Harris had nothing further to add on behalf of Mr Chung.

Reasons For Penalty

The Penalty Guide starting point for a first offence involving 3 consecutive strides is a $300 fine.

After considering the film evidence and the submissions and having due regard for the number of consecutive strikes (3), the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis the Respondent is fined $300.

Conclusion

The Respondent is fined $300.
