SUMMARY OF FACTS:

Following the running of Race 8, the Super Seth @ Waikato Stud Mile, Mr Jones presented an Information alleging that Mr Pinn, the Rider of OCEAN BILLY, struck his mount more than 5 times prior to his horse reaching the 100 metre point, in breach of Rule 638(3)(g)(i).

SUBMISSIONS:

Mr Jones demonstrated from the race film that Mr Pinn struck his mount, OCEAN BILLY, 7 times with his whip on the home straight prior to the 100 metre mark.

REASON FOR DECISION:

Mr Pinn, assisted by Mr Harris, admitted the breach and it is therefore deemed proved.

SUBMISSION FOR PENALTY:

The horse finished 5th and earned a stake of $600.  Mr Pinn’s share of that was $15 (as an Apprentice, one half of 5%).  Mr Pinn has had one previous breach of the “Whip Rule” in the past 6 months.

REASON FOR PENALTY:

The Penalty Guide (for a second offence) requires a starting point of the greater of a $500 fine or 50% of the Jockey share of a stake.

CONCLUSIONS:

There are no aggravating factors and accordingly Mr Pinn is fined $500.
