FACTS
Following the running of Race 6, Mr T Mitchell the Driver of ‘PIXIE’ admitted a charge of careless driving. The carelessness being that near the 400m he allowed his drive to strike the sulky wheel of ‘JOHN WAYNE’ which punctured.
Mr Mitchell said that he understood the Rule, charge and confirmed that he admitted the breach.
Mr Dooley showed film replays and identified where Mr Mitchell came out away from the pegs and then went back in and as he was not clear he hit the wheel (outside) of ‘JOHN WAYNE’.
Mr Mitchell agreed with the Stipendiary Steward’s interpretation.
DECISION
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS
Mr Mulcay said that Mr Mitchell’s record was all clear. He placed the careless driving at the low-end. Mr Mulcay said an aggravating factor was that ‘JOHN WAYNE’ suffered a punctured tyre.
Mr Mitchell said that his record was very good.
REASONS FOR PENALTY
The Penalty Guide starting point is a Fine of $300.
Taking into account the excellent record and admission a fine of $250 was considered appropriate.
CONCLUSION
Mr Mitchell was fined $250.
