SUMMARY OF FACTS:
Following the running of Race 1 Mr Mulcay instigated a protest against the 3rd placed horse AEONIAN alleging that ‘AEONIAN broke inside the 50 metres and was lapped on by MOCCA FANCY and DEL SHANNON’.
Mr White, representing the connections, was present at the hearing and signed the Information to the effect that he did not contest the protest.
Mr Mulcay identified the horse AEONIAN as the field passed the 50 metres mark. The horse had been challenging and went offstride and galloped to the finish. It was lapped on by MOCCA FANCY and DEL SHANNON at the finishing post.
REASON FOR DECISION:
The protest was not contested. The Rule allows the Adjudicating Committee to relegate the breaking horse to behind those horses lapped on.
CONCLUSIONS:
AEONIAN was relegated to 5th and the official placings became:
1st        MM SUNSHINE
2nd       CYCLONE LEBRON
3rd       MOCCA FANCY
4th       DEL SHANNON
5th       AEONIAN
Authority was given for stakes and dividends to be paid in accordance with the amended placings.
