Penalty: Junior Driver Henry Sail is suspended for 2 days

EVIDENCE:

Following the running of Race 8, Chief Stipendiary Steward Mr Nigel McIntyre presented an Information alleging a breach of Rule 869(3)(b) by Junior Driver Mr Henry Sail.

Mr Sail stated he was conversant with the Rule, the Charge and confirmed he admitted the breach. Mr Sail, a Junior Driver, said he was comfortable without the assistance of a Senior Driver.

Mr McIntyre played the video of the race and identified Mr Sail (TONY MAC) racing in last position following AVEROSS MAJESTY (R May). He pointed to, at approximately the 1150m, Mr Sail strike the wheel of Mr May, which deflated.

Mr Sail made no submissions.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr McIntyre alluded to the Penalty Guidelines and said the breach was low level. Mr McIntyre said Mr Sail’s record is clear and he would leave it to the Adjudicative Committee to find an appropriate penalty.

Mr Sail made no submissions on Penalty, but asked for a suspension rather than a fine. Mr Sail also asked if he could defer penalty until after the Cheviot meeting on Sunday.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $300 fine starting point for a first breach of the Rule.

The Adjudicative Committee has no objection to Mr Sail’s request to be suspended instead of fined.

Mr Sail has frankly admitted the breach, has a clear record and the Adjudicative Committee, in considering Mr Sail’s status as a Junior Driver, finds a 2-day suspension appropriate in this case.

CONCLUSION:

Deferment is granted and Junior Driver Mr Henry Sail is suspended from the conclusion of racing on 6 April, up to and including racing on 11 April 2025.
