SUMMARY OF FACTS:

Following the running of Race 1, the Respondent Mr A Mudhoo admitted a charge of Careless Riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that Mr Mudhoo (HERE COMES TROUBLE) allowed his mount to angle out buffeting and unbalancing both ANTIPODES and LATIN QUARTER passing the 500m.  Mr Mudhoo confirmed his admission of the breach and had Ms K Clapperton assisting him.

EVIDENCE:

Mr Goodwin had Mr Davidson outline the incident using the available films.  As the field approached the 500m Mr Mudhoo was 3-back on the fence.  Shortly after he moved his mount forward and then shifted out for a run when not clear of outside runners.  As a consequence of the shift ANTIPODES was forced out onto LATIN QUARTER with both runners being buffeted and forced wide on the track.

Mr Mudhoo had nothing to say.

Ms Clapperton said that the mistake Mr Mudhoo made was to dig his mount up and that if he had not shifted out, he would have been on top of the horse in front of him.

REASON FOR DECISION:

As Mr Mudhoo admitted the breach the Adjudicative Committee found the breach proved.

SUBMISSION FOR PENALTY:

Mr Goodwin produced Mr Mudhoo’s record which proved clear over the last 12 months.

The Stewards placed the carelessness just below mid-range.

Mr Mudhoo said that he wanted any suspension imposed to start after 11 December.

He added that he had had 316 rides in the last 12 months.

REASON FOR PENALTY:

The Adjudicative Committee placed the careless riding between low and mid-range with a starting point of 6 riding days suspension being adopted.  This being in line with the Penalty Guide.

Taking into account the clear record and admission of the breach, a one day discount was deemed appropriate.

CONCLUSIONS:

Mr Mudhoo’s Jockey’s Licence was suspended from the end of racing on 11 December until the close of racing on 19 December 2021 (5 days).
