Background:
Following the running of Race 4, the ‘The Bold One @ Grangewilliam Stud Mdn 2yo & Up’ an Information was lodged alleging a breach of Rule 638(3)(f)(iii). The Information read as follows:
‘used the whip on her mount ‘Missu’ when out of contention of finishing in the first five placings’.
Rule 638(3)(f)(iii) provides .. (f) A Rider must not use his or her whip: (iii) when the Rider’s horse is out of contention of finishing in the first five placings’.
With the assistance of Mr Laking, the Respondent confirmed that she understood the pertinent Rule and admitted the breach.
Evidence:
Stewards, by way of film, identified the incident. Upon entering the home straight, MISSU was positioned against the fence at the rear of the field. The Respondent is seen to strike her mount on 3 occasions, between the top of the straight and the 200 metres. The horse is struck again on an additional 5-6 occasions, between the 200 metre mark and the finish line. MISSU finished 8th in the 10 horse field, 15.1 lengths from the winner. When asked for comment, Ms Floorman referred to her actions as reflecting a lack of experience. She confirmed that her mount did not respond to being struck.
Decision:
As the charge was admitted, it was deemed proved.
Submissions as to Penalty:
Stewards advised the Respondent’s record. Since commencing riding, the Respondent has had some 87 rides. Her record does remain clear, although she had received a warning under this Rule at the Riverton RC Meeting on the 9th May 2025. Stewards recommended a penalty in accordance with the current Penalty Guide ie: a fine of $300. The Respondent did not offer comment in respect of Penalty.
Reasons for Penalty:
Film clearly identifies the breach. The current Penalty Guide provides for a $300 fine for a breach of this Rule, 1st offence. The Adjudicative Committee found no compelling reason to deviate from this. Therefore, upon consideration, a fine of $300 is determined to be the appropriate penalty.
Conclusion:
Apprentice Jockey Ms Floor Moerman is fined a sum of $300.
