Penalty: Class B Rider Teddy Ladouceur is fined $500

Mr Davidson alleged that in Race 7, Mr Ladouceur struck his mount REDFORD 8 times prior to the 100 metres.

Mr Davidson demonstrated on the videos, that the Respondent was racing on the fence as the field progressed up the home straight. The majority of the field was racing wide on the track. He used his whip 8 times prior to the 100 metres.  Mr Davidson added there were no further strikes after the 100 metres.

Mr Ladouceur agreed with the Stewards’ count. He commented that he been counting the strikes and must have missed one.

Mr Laking said it was a misjudgement. REDFORD, being hard up against the rail, was some distance from the rest of the field, which had fanned out looking for better ground.

Decision 

As Mr Ladouceur has admitted the breach, it is found to be proved.

Mr Davidson produced the Respondent’s record, which evidenced no breach of this Rule in the past 6 months.

Reasons for Penalty

The Penalty Guide provides a $500 starting point for a 1st breach where the count is 8 strikes. The appropriate penalty, having regard to record and number of strikes, is a fine of that magnitude.

Conclusion

Mr Ladouceur is fined the sum of $500.
