Penalty: Jockey Samantha Wynne was suspended for 5 National Riding Days

Evidence:

At the conclusion of Race 11, Stipendiary Steward Mr M Davidson filed an Information under Rule 638(3)(g)(i) that Miss Wynne struck her mount COSY NOOK 6 times prior to the 100m.

The Rule provides: A Rider must not strike a horse with a whip more than 5 times prior to the 100m.

Miss Wynne admitted the breach and confirmed she understood the Rule and was present throughout the hearing.

Submissions:

Stipendiary Steward Mr Munro showed video replays of the final 400m of the race where he highlighted COSY NOOK, ridden by Miss Wynne, being struck 6 times from the 350m mark to the 100m.

Miss Wynne agreed with Mr Munro’s number of strikes and simply stated that she had made an error of judgement in counting the strikes.

Decision:

Miss Wynne has admitted the charge which is found proved accordingly.

Submission For Penalty:

Mr Davidson refers to Miss Wynne’s record which unfortunately is disappointing. She has had 4 previous offences from 31/10/2021 ($250, 6 strikes, Ashburton Racing Club), 6/11/2021 (6 strikes, 7 day suspension, Canterbury Jockey Club), 6/11/2021 (7 strikes, $500 fine, 5 day suspension, Canterbury Jockey Club), 13/11/2021 (7 strikes, 8 day suspension, $1500 fine, Canterbury Jockey Club).

Mr Davidson did, however, state that Miss Wynne had only just come back race riding from a 4 month lay off and by her own admission she was still getting race riding fit and may have on this occasion committed to too many rides on the day.

Mr Davidson had some sympathy for Miss Wynne on this occasion, and also made mention of the extraordinary circumstances that had occurred throughout the two day carnival at Riverton Racing Club which had been extremely frustrating, testing Riders, Club Officials, and all involved.

Mr Davidson stated the NZTR Revised Penalty Guide 1st March 2022 recommends for a fifth breach and one additional strike a suspension of 5+ days may be appropriate.

Miss Wynne had no submissions on penalty, however did seek a deferment until after the Canterbury Jockey Club meeting on 23/04/2022.

Reasons For Penalty:

The video evidence is very clear, highlighting Miss Wynne striking COSY NOOK 6 times prior to the 100m. Despite Miss Wynne’s disappointing record, credit must be given for her early admittance of the breach and frankness surrounding her comeback to race riding.

The NZTR Revised Penalty Guide 1st March 2022 provides for a 5+ national day suspension, and after taking in the extenuating circumstances, the Adjudicative Committee believes a 5 day suspension is appropriate.

Conclusion:

Miss Wynne is granted a deferment and is suspended for 5 national riding days, commencing after the conclusion of racing on 24 April 2022 until the conclusion of racing on 29 April 2022.
