Penalty: Jockey Brett Murray was fined the sum of $200
Evidence:
Stipendiary Steward Mr M Davidson presented Information A16062 alleging that Jockey B Murray under Rule 330(3)(c) failed to make the contracted weight for SENTIENT in Race 11, the Martin Forde/AB Lime.
Mr Murray admitted the breach and confirmed he understood the Rule and was present at the hearing.
The Rule 330(3)(c) states that:Â a rider shall not fail to ride a horse which it is handicapped to carry.
Stipendiary Steward Mr Davidson advised that SENTIENT was handicapped to carry 55kg and that Mr Murray had advised the Stewards that he was unable to make the declared weight and would be at least 1kg overweight.
Mr Davidson stated that Mr Murray was replaced by Mr K Mudhoo on SENTIENT.
Mr Murray stated that he had become dehydrated during the day and the day had become very long due to the power outage and injury to a Jockey and so he had drunk a lot of water.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved, Rule 915(1) (d) refers.
Submissions For Penalty:
Mr Davidson stated that Mr Murray did not have a great record under this Rule and was fined a sum of $400 on the 29/01/2022 at the Canterbury Jockey Club and received a further $300 fine on 11/03/2022 at the Wyndham Racing Club.
Mr Davidson had some sympathy for Mr Murray on this occasion as it had been an extremely difficult two days at the Riverton Racing Club for Jockeys, Officials, and all concerned. Long delays due to power outages, the eventual abandonment of day one and then further power outages and a Jockey injured on day two, compounded the issues for all concerned. Mr Davidson recommended a fine was appropriate in the vicinity of $200.
Mr Murray endorsed Mr Davidson’s comments.
Conclusion:
Given the exceptional circumstances around the two day meeting and an extremely long delay leading up to Race 11, Mr Murray has been given some leniency in fixing penalty despite this being his third charge in recent times. Mr Murray was fined the sum of $200 and reminded of his obligations in the future.
