Evidence:
At the conclusion of Race 2, Information A15888 was lodged by Stipendiary Steward, Mr M Davidson alleging that Jockey, Mr J Lowry weighed in .6kg over his weigh out weight being a total of 1 kg over the carded weight.
Mr Lowry was present at the hearing and confirmed he understood the Rule and that he admitted the breach.
Decision:
As Mr Lowry admitted the breach it is found proved.
Submissions for Penalty:
Mr Davidson stated that Mr Lowry had received a warning on the 3/12/2021 regarding this particular Rule. He believed the breach was at the low end of the scale in this instance and could be dealt with by way of a fine.
Mr Lowry stated that his ride DECEPTIO VISUS was the lightest he had on today’s card and that he had changed some sponge pads that may have attributed to the increase and that also he had had a drink of water after having weighed out.
Reasons For Penalty:
After considering submissions the Adjudicative Committee took into account both Mr Davidson and Mr Lowry’s comments and believed a fine at the low end of the scale was appropriate.
Conclusion:
Mr Lowry was fined the sum of $100 and reminded of his professional obligations around this issue .
