Penalty: Apprentice Rider Ruvanesh Muniandy is fined $1,150

EVIDENCE:

Following the running of Race 7, the Listed WARSTEP STAKES, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Apprentice Jockey Mr Ruvanesh Muniandy.

Mr Muniandy stated he was conversant with the Rule and the Charge and confirmed he did admit the breach. Mr Muniandy was assisted at the hearing by Apprentice Mentor Mr Jason Laking.

Mr Davidson had Stipendiary Steward Mrs Rebecca Haley, identify Mr Muniandy (LOOSE SALLY) racing down the centre of the track approaching the 350m. Mr Davidson pointed to Mr Muniandy strike his horse 7 times prior to the 100m and a further 5 times before the winning post.

Mr Muniandy and Mr Laking made no submissions.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson stated Mr Muniandy had been fined earlier in the day under the same Rule and therefore this is now Mr Muniandy’s second breach. He said this race, being a Black-Type Race, the starting point for a fine would be 50% of the Jockey’s share of the stake earned by their mount, or the starting point on the whip table, whichever is greater.

Mr Muniandy and Mr Laking made no submissions.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $500 starting point for a second breach of this Rule with 2 additional strikes.

This is a Black-Type Race and the Jockey’s share of the stake is $2,300.  50% of this equates to $1,150 which is obviously greater than the whip penalty table.

The Adjudicative Committee acknowledges this is a significant penalty for an Apprentice Rider, but finds it appropriate in this case.

CONCLUSION:

Apprentice Jockey Mr Ruvanesh Muniandy is fined $1,150.
