EVIDENCE:
Following the running of Race 4, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Jockey Miss Samantha Wynne.
Miss Wynne stated she was conversant with the Rule and the Charge and confirmed she did admit the breach.
Mr Davidson had Stipendiary Steward Mrs Rebecca Haley, identify Miss Wynne (POMANDER) racing mid field on the rail approaching the 450m. Mr Davidson pointed to Miss Wynne strike her horse 8 times prior to the 100m.
Miss Wynne made no submissions.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson stated Miss Wynne had breached this Rule twice on the same day at the Cup Meeting at Riccarton in November. He said this being her third breach within the reset period, the Guidelines indicate a 5+ day suspension as Penalty.
Miss Wynne requested a deferment of Penalty to allow her to fulfil engagements next Saturday.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5+ day suspension starting point for a third breach of this Rule with 3 additional strikes.
The Adjudicative Committee considers a 6-day suspension appropriate, given the absence of any other relevant factors.
Miss Wynne’s request to defer is granted.
CONCLUSION:
Class A Jockey Miss Samantha Wynne is suspended from the conclusion of racing on 3 May 2025, up to and including racing on 14 May 2025.
