EVIDENCE:
Following the running of Race, 4 Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Apprentice Jockey Mr Ayush Mudhoo.
Mr Mudhoo stated he was conversant with the Rule and the Charge and confirmed he did admit the breach. Mr Mudhoo was assisted at the hearing by Apprentice Mentor Mr Jason Laking.
Mr Davidson had Stipendiary Steward Mrs Rebecca Haley, identify Mr Mudhoo (MATETSI) racing outside the leader approaching the 400m. Mr Davidson pointed to Mr Mudhoo strike his horse 10 times prior to the 100m.
Mr Mudhoo and Mr Laking made no submissions.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson stated Mr Mudhoo had a clear record and a suspension in line with the Guidelines would be appropriate.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5-day suspension starting point for a first breach of this Rule with 4 or more additional strikes.
The Adjudicative Committee considers there are no factors to depart from Guidelines and a 5-day suspension to be appropriate.
CONCLUSION:
Apprentice Jockey Mr Ayush Mudhoo is suspended for 5 days, from the conclusion of racing today, 26 April, up to and including racing on 4 May 2025.
