EVIDENCE:

Following the running of Race 6 Stipendiary Steward, Mr M Davidson presented an Information alleging a breach of rule 638(3)(e) by Apprentice Jockey, Meghann Gestain which was admitted. Miss Gestain was assisted at the hearing by Licenced Trainer, Mr Michael Pitman.

Mr Davidson showed the available videos of the race and identified Miss Gestain (QUEEN SWEEP) racing towards the rear of the field on the rail.

Mr Davidson counted 6 strikes by Miss Gestain which she agreed with, as did Mr Pitman.

REASON FOR DECISION:

As Miss Gestain admitted the breach, the charge was found proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson stated Miss Gestain has a good record but unfortunately was warned for her whip use on the 2nd of October. This he said has made her eligible for a first offense starting point, whichever is greater, a $250 fine or 50% of jockey share of stake. He said the percentage was non-applicable in this case.

CONCLUSIONS:

Accordingly, Miss Gestain is fined $250.
