EVIDENCE:

Following the running of Race 4 Stipendiary Steward, Mr Davidson presented an Information alleging a breach of the Whip Guidelines by Tegan Newman which was admitted.

Mr Davidson showed the video replay and identified Miss Newman (OUR ECHO) who won the race, striking her horse 6 times prior to the 100 metres.

Miss Newman stated she was conversant with the Rule and admitted the 6 strikes.

REASON FOR DECISION:

As Miss Newman has admitted the breach it was found proved.

SUBMISSION FOR PENALTY:

Mr Davidson stated Miss Newman was warned on 27 May 2021 at Counties. He said the Guidelines provide for a first offence, a fine of $250 or 50% of Jockey share of stakes whichever the greater. He said Miss Newman’s 50% of the winning Jockey’s percentage for the race was $431.

Miss Newman made no submissions on penalty other than to say she was poor.

CONCLUSIONS:

Miss Newman is fined $400.
