Penalty: Apprentice Rider Kavish Chowdhoory is suspended for 5 days

EVIDENCE:

Following Race 10, an Information was filed by Stipendiary Steward, Mr M Davidson alleging a breach of Rule 638(3)(e) by Apprentice Rider, Mr Kavish Chowdhoory which was admitted.

Mr Davidson showed the video replays and identified Mr Chowdhoory racing mid-field and pointed to him striking his mount 6 times prior to the 100 metres.

Mr Chowdhoory confirmed to the Committee he was conversant with the Rule and agreed with Mr Davidson’s assessment.

REASON FOR DECISION:

As the charge was admitted, it was found proved.

SUBMISSION FOR PENALTY:

Mr Davidson said Mr Chowdhoory has had 2 prior breaches within the last 6 months.

The first was at Riverton on 8 May where he was suspended for 5 days for 7 strikes prior to the 100 m.

The second at Riccarton on 14 August – 7 days for 7 strikes.

Mr Davidson said todays breach was low level and informed the Committeer Mr Chowdhoory was about to start a suspension relating to a Careless Riding charge which would end on the 30th October.

Mr Pitman, for Mr Chowdhoory, asked if there could be some leniency given as this suspension would almost certainly encompass the first day of the upcoming NZ Cup meeting. He asked if a fine could be substituted for a day’s suspension to allow Mr Chowdhoory to ride on the 6th of November as he had missed this day last year through injury.

Mr Davidson and Mr McIntyre agreed that a 5-day suspension beginning at the conclusion of Mr Chowdhoory’s “careless” suspension would be harsh for a low-level whip breach as it would encompass 3 South Island days including the first day of the NZ Cup meeting. Mr Davidson made a suggestion that Mr Chowdhoory defers this suspension until after 2 November which mitigates the severity of a proposed Penalty.

Mr Walsh agreed it was unfortunate that these racing dates have fallen harshly for Mr Chowdhoory but suggested he should make the best of a bad situation and defer as was suggested.

REASON FOR PENALTY:

The Penalty Guide provides for a 5-day suspension for a 3rd breach of the Rule plus 50% of the Jockey’s share of stake.

Mr Chowdhoory’s share of stake is minimal and as a low-level breach, an appropriate penalty is a 5-day suspension.

Although this Committeer has some sympathy for the situation, there is no bargaining here, ” money for days” in this matter.

Deferment is granted pursuant to Rule 1106.

CONCLUSION:

Mr Chowdhoory’s Licence to ride is suspended from 3 November to 9 November 2021 inclusive.
