Penalty: Apprentice Jockey Triston Moodley was fined the sum of $150
Evidence
Following the running of Race 4, the Respondent Class B Rider Triston Moodley, admitted a charge alleging use of whip in consecutive strides in “that he struck his mount BRACERO in consecutive strides over the concluding stages.”
Mr Moodley had Senior Rider assistance at the Stewards’ investigation, but declined assistance at the hearing.
Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:
(ii) strike a horse with a whip in consecutive strides at any stage of the race.
Using the available race films, Stipendiary Steward Mr Davidson demonstrated that the Respondent struck his mount BRACERO 2 times consecutively near the 400m. Mr Davidson added that Mr Moodley did not use the whip again over the concluding stages, as BRACERO was a beaten runner.
In response, the Respondent concurred that he was in breach of the Rule.
Decision
As Mr Moodley admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
Submissions for Penalty
Mr Davidson produced the Respondent’s record, which indicated a 1st breach warning at Riccarton on 25 May 2024.
Stewards assessed the breach as low level and submitted a penalty commensurate with the NZTR Revised Penalty Guide, for a second offence for 2 consecutive strikes, being a fine of $150.
Mr Moodley elected to make no submissions in regard to penalty.
Reasons for Penalty
The Penalty Guide starting point for a second breach where there are 2 consecutive strikes, is a fine of $150.
After considering the film evidence and the submissions and having due regard for the number of consecutive strikes, the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.
On that basis, the Respondent is fined $150.
Conclusion:
Mr Moodley is fined the sum of $150.
