Penalty: Holder of Licence to Train, Barry Ward, is fined $100

Stipendiary Steward, Paul Williams, filed Information A20078 alleging that holder of Licence to Train, Barry Ward, as the Trainer of ANYTIME AT ALL and HEY TONIGHT, failed to present those horses on course by the required time for Race 1, Waterways and Civil Mobile Pace.

Mr Ward had endorsed the Information form “I do admit a breach of the Rule”. Given the minor nature of the charge, his attendance at the hearing was waived by the Adjudicative Committee.

Clause 15 of the Programming Conditions provides as follows:

 (a)    The trainer of any horse engaged in any race at a totalisator race meeting shall ensure that such horse is available with an attendant in the official stabling complex (or in its allocated stall). 

(i)  at least one hour prior to the advertised starting time of the first race of the meeting where it is entered in that race, or, if entered in a subsequent race, at least ninety minutes prior to the advertised starting time of the race.

EVIDENCE:

Stipendiary Steward Paul Williams, said that the official start time for Race 1, was 11.35am, so starters for the race were required to be on course by 10.35am. Stipendiary Steward Kylie Carston, reported that Trainer Barry Ward, arrived on course at 10.54am, some 19 minutes late, Mr Williams said.

Mr Ward had received a warning on 16 March 2025 at Banks Peninsula TC, for being late to present a runner on course.

DECISION:

The charge having been admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY;

Mr Williams informed the Adjudicative Committee that the usual penalty for a breach of the Regulation was a fine of $100.

REASONS FOR PENALTY:

The Adjudicative Committee, upon checking earlier cases, was satisfied that the usual penalty for a breach of the Regulation was a fine of $100.

CONCLUSION:

Holder of Licence to Train, Barry Ward, was fined the sum of $100.
