SUMMARY OF FACTS:

Following the running of Race 1 Stipendiary Steward, Mr Shane Renault presented an Information alleging a breach of Rule 869(2) by Amateur Driver Mr Gavin Cook which was admitted.

EVIDENCE:

Mr Renault played the video of the last 400m of the race and identified Mr Cook driving REFINE racing at the rear of the field. He showed as the field entered the straight Mr Cook cross his reins, activate earplugs, and immediately strike his horse once free of the rein.

Mr Cook commented it was easily done for someone like himself who doesn’t drive often.

REASON FOR DECISION:

Mr Cook having admitted the breach it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Renualt stated Mr Cook has had 17 drives this season and 8 the previous. He said Mr Cook was warned in September for using his whip free of the rein hence the charge today. Mr Renault said this is a low-level breach with just one strike outside the Regulations and Mr Cook has immediately driven compliantly for the remainder of the finish.

Mr Cook made no submissions.

REASON FOR PENALTY:

Mr Cook has momentarily breached the Regulations, one strike, which the Committee considers low level. The Penalty Guidelines provide a

fine between $400 and $200 and with no other factors to consider a $200 fine is appropriate in this case.

CONCLUSIONS:

Mr Cook is fined $200.
