Outcome: Proved

Penalty: Apprentice Jockey Erin Leighton is fined $200

SUMMARY OF FACTS:

Following the running of Race 7, the PRH Transport Trophy (Listed Race), Mr Oatham presented an Information alleging that Ms E Leighton breached Rule 648(5) in that she weighed in at a weight in excess of 0.5kg of that at which she weighed out.

Ms Leighton admitted the breach of the Rule.

For completeness the Committee records that although an Apprentice Rider, Ms Leighton did not wish to have a mentor (Mr N Harris was not on course) present for what was a relatively minor matter.

SUBMISSIONS:

The facts were that Ms Leighton weighed out at 54.4kg and weighed in 0.8kg in excess of that, namely at 55.2kg.  The horse she rode was TANNAHILL which started favourite and was well beaten but Mr Oatham said the increased weight was not the reason for that.

Ms Leighton was unsure of the reason for the overweight but accepted that it probably was because the riding boots which she wore when weighing out were mistakenly not those she later wore.

REASON FOR DECISION:

As Ms Leighton admitted the breach, it was deemed proved.

REASON FOR PENALTY:

In line with the Penalty Guide, Ms Leighton is fined $200.

CONCLUSIONS:

Apprentice Jockey Erin Leighton is fined $200.
