SUMMARY OF FACTS:

Following the running of Race 1, the Gartshore Interiors Maiden, Mr Davidson presented an Information charging Mr Kamaruddin with a breach of Rule 638(1)(d) in that he rode carelessly in the home straight approaching the finish.

SUBMISSIONS:

Mr Davidson illustrated the breach as disclosed by the Race film.  Mr Kamaruddin was riding KWAUSSIE GIRL which was challenging within the first four horses at the 100 metre point.  Approximately 75 metres from the finish he allowed his mount to shift out and crowded EL BANDOLERO which was outside and not the required distance behind KWAUSSIE GIRL.  As a consequence, EL BANDOLERO checked.  It finished 5th and KWAUSSIE GIRL finished 4th.

REASON FOR DECISION:

As Mr Kamaruddin admitted the breach it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Kamaruddin has had 2 breaches of the Careless Riding Rule 638(1)(d), in the past 6 months, namely June and July 2021.  The Informant submitted that the degree of carelessness was mid/low range and that Mr Kamaruddin has been a very busy (426 rides) and successful Apprentice this season.

Mr Harris submitted that there was an error of judgement by Mr Kamaruddin at the business end of the race, when he simply mistook the margin for which he was ahead of EL BANDOLERO.  Mr Kamaruddin has riding commitments over the next 7 days (until after 20 November 2021).

REASON FOR PENALTY:

In line with the revised Penalty Guideline (from 1 September 2021), the Committee takes as a starting point a 6-day suspension, but allowance is given for Mr Kamaruddin’s generally excellent record over many rides.

CONCLUSIONS:

Accordingly, Mr Kamaruddin’s Licence is suspended for 5 National Riding Days commencing at the conclusion of racing at Te Rapa on 20 November 2021 and to end after the conclusion of racing on 1 December 2021.
