BACKGROUND:
Information No. A18761 was filed by Senior Stipendiary Steward, Mr A Dooley, against Licensed Class A Trainer, Stephen Marsh, alleging that he “failed to declare a Rider for WELL I NEVER by the required time”.
Mr Marsh was not at the meeting. Ms Maja Carlen, representing the Stable, admitted the charge and indicated that she did not wish to be present at the hearing.
Rule 537 provides as follows:
The Trainer or Owner or lessee (as the case may be) or the Agent of the Trainer or Owner or lessee (as the case may be) for a horse accepted or deemed to have been accepted for a Race shall:
(a) Declare to NZTR the name of the rider of that horse by the time and date specified by NZTR for declaration of Riders for that Race.
The time and date specified for declaration of Riders was 1.00pm on Monday 1 July.
EVIDENCE:
Senior Stipendiary Steward, Mr Dooley, said that Mr Marsh was the Trainer of WELL I NEVER, which had accepted for Race 2 at the meeting. No Rider had been declared for the horse by the specified time.
Ms Maja Carlen, who represented Mr Marsh, advised the Stewards that they had originally intended to run the horse at Tauranga on Sunday 7 July. The decision to make a change and race the horse at Rotorua ,was made after the closing time for the declaration of Riders.
DECISION:
The breach having been admitted, the charge was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Dooley said that Mr Marsh’s record under the Rule was not a good one. This was the fifth breach within the 120 days period.
The most recent breaches were at the Amberley Racing Club on 22 June 2024, and the Auckland Thoroughbred Racing Meeting on 25 May 2024. Both resulted in fines of $150. Previous breaches had been dealt with under the Minor Infringement Scheme.
In light of Mr Marsh’s record, Mr Dooley recommended a fine of $200.
It was noted that Mr Marsh has a large team of horses, racing at different venues.
REASONS FOR PENALTY:
Taking all factors into account, the Adjudicative Committee deemed that a fine of $200 was an appropriate penalty.
CONCLUSION:
Class A Trainer, Stephen Marsh, is fined the sum of $200.
