Mr Lowry admitted a breach of r 330(3)(c) in that he was unable to make the weight on TURF WAR, KERANY, POPPA and MISS OTIS REGETS in Races 1, 3 6 and 9, respectively.

Mr Jones stated that the Respondent had advised the Stewards before the first race that he could not make the weight for four of his mounts today.

Mr Lowry explained there was a lack of Riders and he had felt pressured to ride at 56.5 and 57 kg. He said his body had “put up the white flag”. He said he wanted to be able to have a drink during the day to be able to give of his best for his remaining rides. He could not do this and ride at 57 kg. He thought 58.5 kg was his best weight.

Mr Jones produced the Respondent’s record which evidenced this was Mr Lowry’s third weight breach within 120 days. He had been fined on the previous occasions. He submitted a fine in excess of $250 was appropriate. Connections had been let down and one of the races was a listed race.

Mr Lowry said he had done his best to get to the weight and apologised to the connections of the horses. He believed a break from riding was necessary for him to be able to assess matters.

Mr Lowry has admitted the breach, so it is found to be proved.

This is Mr Lowry’s 4th weight breach within 120 days. A suspension is appropriate to give him time to refocus. The breach relates to four mounts on the day and includes a listed race. Mr Lowry’s apology is noted.

The Respondent is suspended from the end of racing today up to and including 12 March 2022. This is 4 National Riding days.
