Penalty: Jockey Jacob Lowry is fined $275

Mr Davidson demonstrated on the videos that the Respondent made a celebratory gesture two strides before the winning post by raising his whip hand high above his head.

Mr Lowry admitted the charge and said he had become emotional as this was a race that he had badly wanted to win. The race had originally been sponsored by his grandfather and he had come close to winning on three previous occasions and had also missed a winning ride through suspension.

As Mr Lowry has admitted the charge it is found to be proved.

Mr Davidson submitted a penalty in the $300 range was appropriate. Mr Lowry said he believed a penalty at the same level as that at Southland a few weeks earlier, of $250, was appropriate.

The Penalty Guide indicates a starting point of $300. Two previous penalties under this Rule are $400 for a Group One race and $250 for a Listed race. This race is a Group Three. Mr Lowry has admitted the breach and has no previous breaches of this Rule.

A penalty of a fine of $275 is imposed.
