Mr Davidson alleged that Mr Rathoar allowed his mount ROSY CLARK in Race 8, to shift in when not clear of BUSH MILLS BILLY (Mr Jogoo), which was checked passing the 1000 metres.
Miss Haley demonstrated on the videos that Mr Rathoar was racing just in advance of midfield one-off the fence, when his horse rolled in towards the rail, checking BUSH MILLS BILLY. Mr Rathoar was barely one length clear. Mr Davidson said Mr Rathoar had looked earlier, and the video was paused demonstrating this, but a little time later Mr Rathoar shifted in without looking. He described it as a misjudgement due to inexperience.
Mr Muniandy agreed with Mr Davidson’s assessment. He added that BUSH MILLS BILLY had been a tad keen and was over-racing. Mr Davidson replied this was so and was a further reason as to why Mr Rathoar needed to be clear of that horse before shifting ground.
Mr Rathoar said it was a misjudgement. He thought he was clear of Mr Jogoo when he shifted.

As Mr Rathoar has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Davidson produced the Respondent’s record. This was Mr Rathoar’s first breach of the Rules. Mr Davidson said Mr Rathoar had had a limited number of rides over the last couple of years. He described the breach as low range.
Mr Muniandy repeated that it was just a misjudgement by Mr Rathoar. Mr Rathoar stated he wished the suspension to commence immediately.
Reasons for Penalty
Mr Rathoar has shifted ground inwards when not clear of Mr Jogoo, whose mount was racing keenly. Mr Rathoar is an inexperienced Rider who has made a misjudgement. This is his first breach of the Careless Riding Rule. It is a low range breach and from a 5-day starting point, there is a one-day reduction for admission of the breach and good record.
Conclusion
Mr Rathoar is suspended from the end of racing today, up to and including 25 August. This is 4 days.
