Ms Butt (MAYBE) has admitted a breach of r 869(2) in Race 6 in that she used her whip with more than a wrist flicking motion in the run home.

Mr Munro identified the Respondent’s horse on the video and demonstrated that Ms Butt used the whip with more than a wrist flicking motion in the run home on 3 occasions. Ms Butt agreed with this count. She explained she had come forward to reach the horse and this had probably led to the breach.

As Ms Butt has admitted the breach, it is found to be proved.

Mr Munro produced the Respondent’s record.  Ms Butt has had 1595 lifetime drives, 121 drives last season and 5 drives this season. He said Ms Butt had been warned under the Rule on 8 December last. Mr Munro sought a fine of $200. Ms Butt explained she had only recently come back to race driving after a time away.

The breach is low-range in that the Respondent has used her whip with more than a wrist flicking motion on 3 occasions in the run home. Ms Butt’s record under this rule shows no breaches these past 12 months.

Ms Butt is fined the sum of $200.
