Penalty: Junior Driver Devon van Til is fined $200

EVIDENCE:

Following the running of Race 9, Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(7A)(a) by Junior Driver Miss Devon van Til.

Miss van Til stated she was conversant with the Rule, the charge and confirmed she admitted the breach.

Miss van Til was assisted at the hearing by Open Driver Mr Bob Butt.

Mr Williams played all available videos of the incident and pointed to Miss van Til racing on the pylons at the 250m. He said Miss van Til has hit 3 track markers, one of which was left lying on the track. This was confirmed on the video. Mr Williams pointed to a trailing runner, RUBY’S A DELIGHT (M Holbrough), balk and jump at the dislodged marker and break, losing its chance.

Miss van Til and Mr Butt agreed with Mr Williams’ assessment.

DECISION:

The Respondent having admitted the charge, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said Miss van Til had a clear record under the Rule. He said a fine of $100 is usually issued as a MIN for such an offence, but as interference has resulted, an Information was in order and a fine of $200 sought by Stewards.

Miss van Til and Mr Butt submitted a $200 fine was a fair and reasonable penalty.

REASONS FOR PENALTY:

The Adjudicative Committee accepts Mr Williams’ submissions, as does Miss van Til and Mr Butt, and finds a $200 fine as appropriate in the circumstances of this case.

CONCLUSION:

Junior Driver Miss Devon van Til is fined $200.
