EVIDENCE:

Following the running of Race 6, Stipendiary Steward Mr Matt Sole presented an Information alleging a breach of Rule 869(4)(6)(b)(c) by Driver Mr Alan Clark.

Stipendiary Steward Mr Renault said Mr Clark had loaded his horse and was starting to leave the Racecourse, when he managed to track him down. Upon Mr Renault explaining the charge, Mr Clark asked if Mr Renault would sign the Information, I do admit the breach of the Rule, on his behalf.

The Adjudicative Committee judged it appropriate in the circumstances, to proceed with the hearing without Mr Clark in attendance.

Mr Sole played the race video to identify Mr Clark (IMPERIAL COMMAND) racing one out, three back, in the running line. He pointed to DEM BONES DEM BONES (B Hope) improving 3 wide outside Mr Clark at approximately 1100m. Mr Sole pointed to Mr Clark shift his horse out 3 wide, dictating Mr Hope 4 wide and forcing Mr Hope to race 4 wide for 200m.

Mr Sole stated it was a clear pushout breach.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Sole stated Mr Clark has had 714 lifetime drives, 26 this season and a clear record under the Rule.

Mr Sole said for a first breach of this Rule, a $200 fine is appropriate.

REASONS FOR PENALTY:

The Penalty Guidelines provide for a $200 fine for a first breach of the Rule.

The Adjudicative Committee can see no factors in this case to depart from the Guidelines.

CONCLUSION:

Driver Alan Clark is fined $200.
