SUMMARY OF FACTS:

The information alleged that TOP HAT AND TAILS, placed 4th by the Judge in Race 1, Dunstan Horsefeeds Mobile Trot, “broke in excess of 150 metres shortly after the start”.

EVIDENCE:

Mr Renault showed a video replay of the first 200 metres of the race, a 1980 metres mobile start event for trotters. He pointed out TOP HAT AND TAILS (J R Dunn), drawn barrier position 3, go into a break shortly after the start and continue on in a gallop for, he alleged, approximately 160 metres. Mr Renault demonstrated the distance by reference to the track markers which were 21 metres apart, he said. Mr Renault sought disqualification of TOP HAT AND TAILS.

Mrs Glass and Mr Fergus did not dispute the alleged distance for which the horse galloped, but submitted that it was quite close.

REASON FOR DECISION:

The Adjudicator was satisfied that TOP HAT AND TAILS had broken, free of interference, shortly after the mobile start and had continued on in a gallop for a distance in excess of 150 metres. In terms of the Breaking Horses Regulations, the Adjudicator was required to disqualify the horse.

CONCLUSION:

The protest was upheld and TOP HAT AND TAILS was disqualified. Consequent upon the disqualification, the amended result for the race is as follows:

It was ordered that dividends and stakes be paid in accordance with the amended result.
