SUMMARY OF FACTS:

Following the running of Race 3, the Fairview Motors Matamata 1400, Mr Davidson presented an Information charging Mr Asano with a breach of Rule 638(1)(d), by careless riding at about 250 metres from the finish.

Mr Asano admitted the breach.  He had had the assistance of his Agent when viewing the race film prior to the charge being laid, and had accepted the advice he received that he should have admitted the breach.  Accordingly, he did not wish to be assisted or represented before the Adjudicative Committee and waived his entitlement under Rule 916(2).

SUBMISSIONS:

Mr Jones illustrated from the head and side on race films the careless riding. Mr Asano was riding OUTFIT which was travelling well back in the field, upon entering the home straight.  There was no clear run open to him so he angled his mount out at about the 250 metre point.  He was not sufficiently clear of OH TO BE on his outside and contact occurred so as to buffet and unbalance that horse, which lost its momentum.  OUTFIT proceeded to finish strongly, into 3rd place.  OH TO BE was unplaced.

REASON FOR DECISION:

As the breach was admitted, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Davidson advised that his opinion was that the breach was just below midrange.  He said that Mr Asano, despite 2 offences for careless riding in March and May 2021, was entitled to credit for his generally excellent record over 479 rides over 12 months.

REASON FOR PENALTY:

The Committee accepts that a starting point of a 5 day suspension is appropriate.

CONCLUSIONS:

Mr Asano has committed riding engagements for the next 7 days.  Taking as a guide, the same starting, and end point of 5 days suspension, Mr Asano’s Licence is suspended for 5 days from the end of racing at Te Rapa on 11 December 2021, to finish at the conclusion of racing on 19 December 2021.
