Penalty: Jockey Corey Wiles is suspended for 2 Race Days

Background:

Following the running of Race 1, the ‘Lest We Forget 2000’, an Information was lodged alleging a breach of Rule 638(1)(d).

Details of the breach are as follows:

‘permitted his mount ‘Blackcomb’ to shift inwards when not sufficiently clear of  ‘Joyola’ which was checked near the 1600 metres’

Mr Wiles confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.

Rule 638(1)(d) provides:

‘A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be (d) careless:’

Evidence:

Using available film, Stewards identified the incident and horses involved. Approaching the winning post on the first round, BLACKCOMB is situated toward the rear of the field and is 2-3 horse widths off the fence. At this point, the Respondent looks to cross to the fence. When doing so, he is insufficiently clear of JOYOLA, who is against the fence. As a result of this movement, JOYOLA is checked, collides with the rail and loses ground. When asked for comment, Mr Wiles admitted an error in judgement and added the horse was hanging and was a difficult ride.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Stewards advised of the Respondent’s clear record as it relates to any breach of this Rule within the last twelve months.  It was the Stewards’ contention that the incident sat mid range in respect of carelessness. The Adjudicative Committee was referred to the current NZTR Penalty Guide. Mr Wiles did not offer comment in respect of Penalty, although sought deferment of any suspension to enable fulfilment of riding engagements at Te Rapa on 4th May 2024.

Reasons for Penalty:

The Adjudicative Committee was satisfied that the incident is identified by available film. The ‘head on’ in particular, was helpful in highlighting the effect of the breach, in that JOYOLA was checked and collided with the rail. As such, the Adjudicative Committee concurs with the Stewards’ contention that the breach represents mid range carelessness. Guidelines currently provide for a 2 day suspension in this circumstance. After consideration of matters, a 2 day suspension was deemed the appropriate sanction. The Respondent’s request for deferment was granted.

Conclusion:

Mr Wiles’ Licence to ride in races is suspended for 2 days, from the close of racing on 4th May 2024, up to and including 19th May 2024. The 2 days noted (where Jumping or Highweight Racing is scheduled) are Wanganui on 9th May 2024 and Hawera on 19th May 2024.
