SUMMARY OF FACTS:

Following the running of Race 4 Ms Lynsey Satherley the Rider of FLASH MARY (1st) was charged with using her whip 6 times prior to the 100m (5 is the limit).

EVIDENCE:

The film replays were shown with Mr Oatham pointing out where Ms Satherley struck her mount 6 times before reaching the 100m.

Ms Satherley agreed with the number.

REASON FOR DECISION:

As the charge was admitted it was found proved.

SUBMISSION FOR PENALTY:

Mr Oatham said Ms Satherley has had two breaches of the Rule in the last 6 months.  Those being 22 May ($300 fine) and 10 July ($500 fine).  He referred to the Penalty Guide starting point which stated 5 Riding Days Suspension and 50% of a Rider’s percentage of the stake, which on this occasion was in round figures $400.

FLASH MARY won the Race with first prize being $17250.

REASON FOR PENALTY:

The Penalty Guide starting point was considered to be a suitable penalty.

CONCLUSIONS:

Ms Satherley’s Jockey’s Licence was suspended from the end of racing on 1 October through to all racing on 8 October 2021 and a fine of $400 imposed.
