SUMMARY OF FACTS:

Mr Williamson informed the Adjudicative Committee that Mr O’Leary had two runners in Race 2 namely Captains Run (Mr M Cropp) and Elusive Ace (Mr R Cole). Both were presented to the birdcage within three minutes from the start of the race.

SUBMISSIONS:

Mr Williamson informed that he was concerned that Mr O’Leary’s actions placed pressure on Stewards in ensuring their obligations were met. Mr O’Leary agreed that his actions were not acceptable. He added that both horses (particularly Captains Run) were difficult  to handle and that he left it as late as possible to saddle and present the horses. He did acknowledge that he may have been short staffed. Mr Williamson whilst agreeing Mr O’Leary was under pressure reiterated the importance of horses being presented on time.

REASON FOR DECISION:

A horse shall be in the birdcage not later than the time fixed by the Stipendiary Stewards (being the time specified in the Club’s race book or otherwise specified by NZTR). Mr O’Leary admitted the breach and it is deemed proved.

SUBMISSION FOR PENALTY:

Mr Williamson informed the Committee that a similar breach (Rotorua May 2021) attracted a fine of $100. When asked, he could not specifically confirm, but by memory suggested circumstances were similar.

REASON FOR PENALTY:

The Committee on considering  submissions consider a fine consistent with that recently imposed is deemed appropriate.

CONCLUSIONS: Mr D O’Leary is fined a sum of $100.
