Penalty: Driver Sean McCaffrey suspended 2 days
SUMMARY OF FACTS:
Following Race 2 Information A17259 was filed with the Adjudicator. It was alleged that Mr McCaffrey the Driver of “HIGHVIEW ROCKN ROLL” used his whip free of the rein late in the race.
Mr McCaffrey admitted the breach and did not wish to be present at the hearing.
Mr Mulcay showed film replays and identified where Mr McCaffrey hit his drive with the whip free of the rein, two to three times over the latter part of the race.
REASON FOR DECISION:
As the charge was admitted it was found proved.
SUBMISSION FOR PENALTY:
Mr Mulcay said that Mr McCaffrey had one prior breach on 30 September 2021 when a fine of $200 was imposed. He referred to the Penalty Guide and recommended that a 2-day suspension would be appropriate as it was a low-level breach.
REASON FOR PENALTY:
The Committee was satisfied that it was in the low-level category and that a 2-driving day suspension was a suitable penalty.
Mr McCaffrey had his Horseman’s Licence suspended from the close of racing on 9 December through to the cessation of racing on 17 December 2021. The two days being Cambridge 16 December and Auckland 17 December 2021.
