Mr Munro sought the disqualification of horse 10, ALWAYS B THERE, placed 2nd by the Judge in Race 8 as it galloped in excess of 50 metres in the final 200 metres.
Judge’s placings were:
1st – 4 HE’S A MEISTER
2nd – 10 ALWAYS B THERE
3rd – 2 MCLEAN
4th – 6 FOVEAUX STRAIT
5th – 11 MR TEDDY
Miss Haley demonstrated on the videos that ALWAYS B THERE galloped for approximately 90 metres in the home straight before returning to a pace some 10 metres before the line.
The connections of ALWAYS B THERE did not contest the protest.
After viewing the videos, the Committee is satisfied that ALWAYS B THERE was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. ALWAYS B THERE was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
As ALWAYS B THERE has gained an advantage over the field, it is appropriate that the horse be disqualified.
Amended placings are:
1st – 4 HE’S A MEISTER
2nd –Â 2 MCLEAN
3rd – 6 FOVEAUX STRAIT
4th – 11 MR TEDDY
Stakes and dividends are to be paid accordingly.
