Penalty: Trainer Brett Gray is fined $150

Following the running of Race 9, Mr Munro presented an Information alleging a breach of r 865(2) by Trainer Mr Brett Gray in that he presented ALWAYS TICKING without sliding blinds.

Mr Munro said this breach of the Rules was usually dealt with by way of the MIN regime, but as this was Mr Gray’s third breach since April, an Information was presented. Mr Gray was fined $100 on 4 April 2024 and again 21 days later, for incorrect gear.

Mr Gray acknowledged his mistake, noting he was training a number of horses at this time and was very busy. He said the horse had blinds, but not the sliding blinds.

DECISION

As Mr Gray has admitted the breach, it is found to be proved.

SUBMISSIONS FOR PENALTY

Mr Munro said a fine in the vicinity of $150 would be appropriate.

Mr Gray made no submissions.

REASONS FOR PENALTY

The Adjudicative Committee in searching similar cases, found a third breach had resulted in a fine of $150 being imposed. The Adjudicative Committee agrees a fine at a level just above the $100 minimum penalty is appropriate.

CONCLUSION

Mr Gray is fined $150.
