SUMMARY OF FACTS:
The Information alleged that Wiremu Pinn (Swords Drawn) used his whip excessively in the home straight.
At the outset of the hearing, Mr Pinn confirmed he understood the Rule and admitted the breach. Ms Clapperton, as Central Districts Apprentice Mentor, was able to confirm this.
Video footage of the race was presented to highlight the incident. Between the 300 and 100 metre mark Mr Pinn struck his horse on six occasions. The limit is five strikes. Mr Pinn struck his mount on three further occasions between the 100 metre mark and finish line. Swords Drawn finished second in the race.
Mr Pinn did not offer specific comment when asked for input.
REASON FOR DECISION:
Mr Pinn admitted the breach, therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Mr Oatham produced Mr Pinn’s record under this Rule.

Recommended was penalty in line with the revised Penalty Guideline – 3rd offence starting point – 5 days suspension plus 50% of Jockey share of stake.
Mr Pinn sought deferment to honor riding commitments.
REASON FOR PENALTY:
Upon considering matters, it is deemed appropriate that penalty is as outlined within the Guidelines ie 5 days suspension. Mr Pinn’s share of the stake was calculated at $370 with 50% being $185. The fine was rounded up to $200.
CONCLUSIONS:
Mr Pinn is suspended from the close of racing on 6th October 2021 up to and including 13th October 2021 – 5 NR days. In addition a fine of $200 is imposed.
