Background

Mr Davidson alleged that in Race 6, Mr May struck his mount SHAKIB in excess of 5 times prior to the 100 metres.

Mr Davidson demonstrated on the videos that the Respondent was making a run towards the centre of the track early in the home straight and struck his mount SHAKIB 6 times prior to the 100 metres.

Mr May said he had a made a mistake. The horse to his outside had been running in and as a consequence, he had given SHAKIB one to the shoulder which was not his usual practice.  He said he had been counting and thought he would have been okay.

Decision

As Mr May has admitted the breach, it is found to be proved.

Submissions as to penalty

Mr Davidson produced the Respondent’s record which showed 2 breaches in the previous six months, one on 29 July and another on 26 December last. He submitted that a penalty in accordance with the Guidelines was appropriate, but with a small uplift in light of the fact that SHAKIB had won the race. Mr May accepted this.

Reasons for Penalty

Mr May has struck SHAKIB 6 times before the 100 metres. The NZTR Guidelines provide for a fine of $500 where there is one additional strike, and the Jockey has 2 previous breaches in the past six months. A small uplift is appropriate for the fact that Mr May went on to win the race.

Conclusion

Mr May is fined the sum of $550 and is reminded of his obligations under the Whip Rules.
