Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Adjudicative Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to r 869(8)) such relegation of the horse shall be at the discretion of the Adjudicative Committee.
Miss Haley demonstrated on the videos that within the final 20 metres DONALD TRUMP broke and continued in a gallop past the finishing line. She explained that the protest was to determine whether DONALD TRUMP was lapped on by 5 CHEEKY MONKEY. She did not believe DONALD TRUMP had gained ground by galloping.
Mr Williamson, the Driver and Trainer of DONALD TRUMP, represented the connections of that horse, and contested the protest.
Mr Ydgren at Miss Haley’s request showed the photo finish on his cellphone. It was clear that the tail and an extended back leg of DONALD TRUMP were the only parts of DONALD TRUMP that were lapped on to CHEEKY MONKEY. The Judge’s margin of one length confirms this.
Mr Williamson submitted the horse was not lapped on. Miss Haley did not disagree. Rule 870(5) has been consistently interpreted as requiring the rump of the horse to be lapped on by the following horse. It was not.
In these circumstances, the protest is dismissed. Stakes and dividends are to be paid accordingly.
