EVIDENCE:

Following the running of Race 7, Stipendiary Steward Mr Matt Sole, presented an Information alleging a breach of Rule 865(2) by Trainer Mr Bruce Negus. “The particulars of the charge are that Mr Negus presented PAIGE to race without the notified pacifiers.”

Mr Sole stated that Mr Negus had presented PAIGE to race without the notified pacifiers.

Mr Sole said these breaches are usually dealt with through the MIN regime, however this is the fourth breach of notifiable gear by Mr Negus and accordingly, an Information was instigated.

Mr Negus stated that he just forgotten to apply the gear. He added that his normal race day team were not there to support him and check he had the right gear on the horses.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Sole stated Mr Negus’ first breach was at Ashburton on 22 December 2024, followed by Westport on 7 March 2025, both incurring a $100 fine under the MIN system. A subsequent breach at Ashburton on 26 March 2025 was filed by way of an information and resulted in a $150 fine.

He said this breach, being Mr Negus’ fourth, requires another uplift, which the Stewards submit should be a fine of $200.

REASONS FOR PENALTY:

As this was Mr Negus’ fourth breach since December 2024, an uplift was warranted on his prior $150 fine for his third offence in March.

An uplift of $50 was deemed appropriate, with a fine of $200 being imposed.

CONCLUSION:

Trainer Mr Bruce Negus is fined $200.
