EVIDENCE:

Mr Davidson alleged that Mr Murray failed to make the contracted weight for RADIANT ROSIE in Race 5 and MAMMA SANS in Race 6.

Mr Murray was to ride RADIANT ROSIE and MAMMA SANS in Race 5 and 6, respectively, at the carded weight of 54 kg. He was unable to do so. Mr Murray explained he had been struggling with his weight for a couple of months. He said he spent time in a hot bath last evening and this morning but had been unable to lose the necessary weight.

REASON FOR DECISION:

As Mr Murray has admitted the breach, it is found to be proved.

PENALTY SUBMISSIONS:

Mr Davidson produced Mr Murray’s record which showed 3 previous breaches of this Rule in the past 6 weeks. Mr Murray had been fined $100, $200 and $300 on these occasions.  Mr Davidson submitted that a fine in the vicinity of $300 was appropriate.

Mr Murray said he preferred a fine to a suspension. Discussion was had with the Stewards as to whether there should be a weight below which Mr Murray could not accept rides. It was agreed that this would be considered.

CONCLUSIONS:

This is a fourth breach in a short period of time. The Committee agrees that the matter can be dealt with by way of a fine on this occasion but notes that both the connections of the horses and those persons investing on them have been inconvenienced by Mr Murray’s inability to ride the two horses in question.

Mr Murray is fined the sum of $350.
