EVIDENCE:
Following the running of Race 9, the HOTELIERS CHALLENGE MAIDEN, Mr Davidson filed an Information charging Mr Murray with a breach of Rule 638(3)(b)(ii) of excessive use of his whip, on his mount SERAPHIC, prior to the 100 metre mark.
SUBMISSIONS:
Mr Davidson showed the race film to identify Mr Murray racing wide on the track, strike his horse on 7 occasions prior to the 100 metre mark.
Mr Murray had signed the Information stating he did not wish to be present at the hearing of the Information. Mr McIntyre advised the Committee that Mr Murray had asked the Stewards to be excused as he had horses that needed his immediate attention.
REASON FOR DECISION:
Mr Murray had signed the Information admitting the breach and it is therefore found proved.
SUBMISSION FOR PENALTY:
Mr Davidson repeated Mr Murray’s record from the same charge in Race 2 and asked that the Committee consider an uplift in Penalty to reflect the seriousness of having 2 whip breaches in one day.
REASON FOR PENALTY:
Mr Murray’s breach is now indeed his 4th breach within 2 months and his second today. The Committee applied the fourth offence Guideline as it had for Mr Murray’s breach in Race 2, of which is the aggravating factor in this case, and uplifted it by 2 days.
CONCLUSIONS:
Jockey Brett Murray is suspended for 7 National Riding Days. This suspension encompasses racing from the 27th August 2021 through to the 8th September 2021 inclusive.
