SUMMARY OF FACTS:

Following Race 6, Inglewood Stud Guineas Trial, Ms Wynne was charged that, as the Rider of MACKENZIE LAD in the race, she used her whip in two consecutive strides.

SUBMISSIONS:

Mr Davidson showed a video replay of the concluding stages of the race. He pointed out MACKENZIE LAD, ridden by Ms Wynne, against the rail in 2nd position nearing the finishing line. He then showed Ms Wynne use her whip in two consecutive strides just before the finishing line, being beaten into 3rd placing by the margin of a nose.

REASON FOR DECISION:

Ms Wynne has admitted the charge which is found proved accordingly.

SUBMISSIONS FOR PENALTY:

Mr Davidson said that the breach is certainly low-end and is a first offence. Ms Wynne had previously received a warning for using her whip in consecutive strides and hence was being charged on this occasion. There were no aggravating factors, Mr Davidson said. The NZTR Revised Penalty Guidelines provide for a fine of $150 for a first offence involving two consecutive strikes.

REASONS FOR PENALTY:

The Penalty Guidelines provide that, for two consecutive strikes after a prior warning, the Stewards shall have a discretion to charge on the same basis as 3 consecutive strikes. For a first offence of three consecutive strikes, the Guide provides for a fine of $150.

CONCLUSIONS:

Jockey Samantha Wynne is fined the sum of $150.
