SUMMARY OF FACTS:

Mr Asano was charged after Race 8, Heatstore Open Handicap, that as the Rider of ROCK ISLAND LINE in the race he used his whip in an excessive manner prior to the 100 metres.

SUBMISSIONS:

Mr Oatham had Stipendiary Steward, Mr Mark Davidson, point out Mr Asano riding ROCK ISLAND LINE, racing towards the rear and wide as the field turned into the home straight. It was well into the home straight, about the 300 metres, before Mr Asano commenced using his whip and, from that point, he used it on seven occasions prior to the 100 metres, the last of those being just before the 100 metres, Mr Oatham said. Mr Asano accepted the alleged count of seven strikes.

REASON FOR DECISION:

Mr Asano has admitted the charge which is found proved accordingly.

SUBMISSION FOR PENALTY:

Mr Oatham said that Mr Asano had a recent breach of the Rule at Whangarei on 17th July – 7 strikes, fined $300. This is therefore a second offence for which the Penalty Guidelines provide a $500 fine. Stewards were submitting that as an appropriate penalty on this occasion.

Mr Walsh asked the Committee to note that Mr Asano’s record is an excellent one, considering the large number of rides that he has across the country.

REASON FOR PENALTY:

This is Mr Asano’s second offence in the last 6 months. The Penalty Guidelines suggest a starting point for a second offence of a $500 fine. There are no aggravating factors or relevant mitigating factors to consider. We record, however, that Mr Asano’s record is a good one.

CONCLUSION:

Mr Asano is fined the sum of $500.
