SUMMARY OF FACTS:

Following Race 4 (Marsh Racing New Stables 1550) Jockey Vinnie Colgan was charged with using his whip more than 5 times prior to the 100m.

EVIDENCE:

Mr Jones showed the film replays and identified where Mr Colgan had struck his mount 7 times prior to the 100m (5 being the limit).  Mr Colgan agreed with Mr Jones’ interpretation.

SUBMISSIONS FOR PENALTY:

Mr Jones said that Mr Colgan had a clear record over the last 12 months.  He submitted that a fine in line with the revised Penalty Guidelines would be appropriate.

Mr Colgan agreed and had nothing further to add.

REASON FOR PENALTY:

As there were no aggravating or mitigating factors to consider it was deemed appropriate that the Penalty Guidelines for a first offence be imposed.

CONCLUSIONS:

Mr Colgan was fined $250.
