FACTS
Mr Kumagai admitted a breach of Rule 638(1)(d). It was alleged by the Applicant, Mr Dooley that Mr Kumagai allowed his mount “DIAMOND PEGASUS” to shift inwards when not sufficiently clear, crowding “MASTER PARK” (J Riddell) onto “RED INFERNO” (V Colgan) which was checked near the 1100m.
Mr Kumagai said that he understood the Rule, Charge and confirmed that he admitted the breach.
Mr Jones showed film replays and explained that Mr Kumagai, when only half a length clear of “MASTER PARK”, shifted in and forced that runner in into “RED INFERNO” with both suffering interference.
Mr Kumagai and Mr Scott agreed with Mr Jones.
DECISION
As the charge was admitted together with the film evidence the charge was proved.
PENALTY SUBMISSIONS
The record showed that this was Mr Kumagai’s first breach of the Rule in approximately 90 raceday rides.
Mr Dooley placed the carelessness in the mid-range category.
Mr Scott said that Mr Kumagai made a mistake, not intentional and that he has to adjust quicker.
REASONS FOR PENALTY
The Penalty Guide starting point for mid-range carelessness is a suspension of 7-Riding Days. Taking into account the excellent record and that the breach was admitted, a discount of two days was afforded.
PENALTY
Mr Kumagai’s Apprentice Jockey’s Licence was suspended from the end of racing on 16 July through until the cessation of racing on 27 July 2022 (5 National Riding days).
