Evidence:
Following the running of Race 4, the “Happy 91st Birthday Colleen Edmonds Handicap Trot”, Mr Mulcay presented an Information charging Mr T Cameron with a breach of Rule 869(3)(b) in that he drove carelessly approaching the 1000 metre point by allowing his horse “AMERICAN MUSCLE” to contact the sulky wheel of “CRUISE LINER”.
Mr Cameron admitted the breach.
The race film, as illustrated by Mr Mulcay, depicted that ‘approaching the 1000 metre mark, Mr Cameron driving “AMERICAN MUSCLE”, shifted out and when not sufficiently clear of “CRUISE LINER”, came into contact with a sulky wheel of that horse, causing the tyre tube to be detached from the wheel rim. As a consequence, the chances of “CRUISE LINER” were extinguished’.
Decision:
As the charge was admitted it was deemed proved.
Submissions for Penalty:
Mr Mulcay advised that Mr Cameron had a clear record under this Rule and the breach is in the low/midrange category. He submitted that a modest fine was sufficient sanction.
Mr Cameron said that he made a minor error of judgment, which the Adjudicative Committee accepts.
Reasons for Penalty:
From a starting point fine of $300, a mitigating discount is afforded because of Mr Cameron’s good record.
Conclusion:
Mr Cameron is fined $250.
