Penalty: Holder of Licence to Train, Barry Ward, is fined $200
Stipendiary Steward, Shane Renault, filed Information A20040 alleging that Holder of Licence to Train, Barry Ward, as the Trainer of ANYTIME AT ALL, an acceptor for Race 1, Wide Span Sheds Mobile Pace, failed to present that horse on course by the required time for the race.
Mr Ward had endorsed the Information Form “I do admit a breach of the rule”. Given the minor nature of the charge, his attendance at the hearing was waived by the Adjudicative Committee.
Clause 15 of the Programming Conditions provides as follows:
(a) The trainer of any horse engaged in any race at a totalisator race meeting shall ensure that such horse is available with an attendant in the official stabling complex (or in its allocated stall).
(i) at least one hour prior to the advertised starting time of the first race of the meeting where it is entered in that race, or, if entered in a subsequent race, at least ninety minutes prior to the advertised starting time of the race.
EVIDENCE:
Stipendiary Steward, Shane Renault, said that the official start time for Race 1, was 11.20am, so starters for the race were required to be on course by 10.20am. It was reported that Mr Ward, arrived on course at 10.50am, some 30 minutes late, Mr Renault said.
DECISION:
The charge having been admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Renault informed the Adjudicative Committee that the usual penalty for a breach of the Regulation is a fine of $100.
Mr Ward had received a fine of $100 on 16 March 2025 at Rangiora HRC, for being late to present two runners on course, he said. For this, a second breach, a fine of $200 would be an appropriate penalty, Mr Renault submitted.
REASONS FOR PENALTY:
The Adjudicative Committee was satisfied that the usual penalty for a first breach of the Regulation is a fine of $100 and noted that Mr Ward had been fined $100 for a similar breach on 16 March. An uplift is required for this second breach, by way of a deterrent to Mr Ward.
CONCLUSION:
Holder of Licence to Train, Barry Ward, is fined the sum of $200.
