SUMMARY OF FACTS:
Following the running of Race 3, Thank You Go Racing Maiden, Jockey, Samantha Wynne, was charged that, as the Rider of BODYGUARD in the race, she used her whip 6 times prior to the 100 metres.
The Rule provides that a Rider must not strike a horse with a whip more than 5 times prior to the 100-metre mark.
EVIDENCE:
Ms Algar showed a video replay of the race from the home turn and pointed out that Ms Wynne had used her whip 6 times on BODYGUARD prior to the 100 metres. Ms Wynne accepted the count of 6 strikes outlining that it was a mistake as she struck her mount too early.
REASON FOR DECISION:
As Ms Wynne admitted the charge and the video evidence supported the charge it was accordingly found proved.
SUBMISSION FOR PENALTY:
Ms Algar said that Ms Wynne had a clear record for this particular Rule and accordingly a fine of $250 should be imposed. Ms Wynne did not make any submissions as to penalty and accepted what the Guidelines outlined.
REASON FOR PENALTY:
Ms Wynne admitted that she used her whip 6 times prior to the 100 metres. The NZTR Revised Penalty Guidelines provide for a starting point for penalty of the greater of a fine of $250 or 50% of theJockey’s share of stake. This breach is regarded as a 1st offence for excess use of the whip prior to the 100-metres mark.
That starting point is an appropriate penalty for this breach, there being no relevant aggravating or mitigating factors.
CONCLUSIONS:
Jockey Samantha Wynne is fined the sum of $250.
